Hiring a personal injury lawyer is a major decision. No question, much is riding on finding the right person to represent your interests, and secure a fair and favorable settlement for you. While it would definitely be convenient, the reality is that most people do not keep an attorney on retainer, or even know one. So, where should you start?

Personal referrals are the best way to start your search for an attorney. Ask friends, family, colleagues, and other professionals for recommendations. However, if none are forthcoming, you could try contacting your state’s bar organization and requesting a list of referrals. You can also check various online lawyer directories and your local yellow pages.

After locating a few possibilities, set up an appointment to meet with each to discuss your case. Most will offer a free initial consultation, which will allow the attorney an opportunity to assess the merits of your case, and you the chance to interview him/her. Do not be afraid to ask questions, or feel pressured to sign any type of retainer agreement on the spot.


Creating a list of questions and concerns you have before your meeting may be helpful in organizing your thoughts. You can start your interview by asking if they:

• specialize in personal injury law.
• handled cases similar to yours. If so, how many and what were the outcomes?
• have gone to trail often on similar cases.
• will take your case on a contingent fee basis, and what other types of fees you will be expected to pay (filing fees, copies, etc.).
• will be handling the case themselves or with another attorney.
• abide by a client’s wishes regarding settlement offers. In other words, if you wanted to continue to trial because you were unhappy with a settlement offer they supported, would they follow your wishes?


While attorney-client confidentiality does not permit an attorney to provide you with past client references, you can still ask for a list of professional references. Other attorneys can often provide good insight into a colleague’s character.

Choosing an attorney to represent your interests is an important step, and a decision that should not be made lightly or hastily. Remember that you have options and should not settle on the first attorney you find. Take your time and make an informed decision.
