The McLaren team, now being accused of spies, must face up to a hearing scheduled on the 26th of July for "unauthorized possession of documents and confidential information belonging to Ferrari", which is a breach of Article 151c of the International Sporting Code. That rule relates to "any fraudulent conduct, or any act prejudicial to the interests of any competition, or to the interests of motor sport generally".

They must answer to FIA’s spy charges and Coughlan, who was suspended last week, has now decided to tell Ferrari how the information got into his possession, following an announcement made by FIA that alleged that such data "could be used to design, engineer, build, check, test, develop and/or run a 2007 Ferrari Formula One car."

Ron Dennis, McLaren’s team boss, has preserved the team's incorruptibility all the way through and is convinced FIA will clear them of any illegal actions. Dennis also made a statement assuring that the indictments will not cause the team any type of embarrassment. Although, in the event that they are indeed declared guilty FIA has the power to expel the team from the championship or might even deduct points from the ranking.
